Throughout the site, the terms “we”, “us”, and “our” refer to Framed Visions, LLC. “You” refers to visitors and consumers of Framed Visions, LLC. This website offers visitors home decor products for purchase. By visiting our site and/or purchasing something from us, you agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

3. Terms for Purchasing

When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process: (iii) you agree to pay the sales tax and shipping rates calculated based on your shipping address that you provide at check-out.

The fee for the products and any other charges you may incur in connection with your purchase, such as taxes, shipping, and possible transaction fees, will be charged at the time of purchase to your payment method. The prices we charge for our products are listed on the website and are carefully chosen based on current material costs and labor. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur.

You agree to promptly update your information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Certain products may have limited quantities and are subject to return or exchange only according to our Return and Refund Policy.

We cannot guarantee that your computer monitor's display of any color will be accurate. Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies or omissions, to change or update information, or cancel orders at any time without prior notice (including after you have made your purchase).

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Product will be corrected. Once Products are received by the buyer, including Products purchased online and Custom Frames Commissioned with Alison Adsit, the buyer assumes all responsibility for the product.

 

4. Shipping Policy

Most orders will be ready to ship within 1-3 business days of purchase via USPS or UPS and arrive within 3-5 business days. Please be aware that due to nationwide shipping delays due to COVID-19, some packages may take longer to arrive. 

 

5. Return and Refund Policy

Returns and refunds are not accepted after your purchase is complete. If products arrive with SIGNIFICANT damage (i.e. broken glass) an insurance claim will be attempted with the shipping service. You agree to contact Framed Visions, LLC within 7 business days of receiving your product if it arrives with significant damage. You agree to provide photos of proof of damage as requested by us. Refunds are not guaranteed and will only be provided up to the amount of insurance coverage by the shipping service. We are not held responsible for damage caused by the purchaser or others. Once Products are received by the buyer, including Products purchased online and Custom Frames Commissioned with Alison Adsit, the buyer assumes all responsibility for the product.

 

6. Right to Change Offerings

We may, without prior notice, change the products, stop providing the products or any features of the products we offer, or create limits for the products. We may permanently or temporarily terminate or suspend access to the products without notice and liability for any reason, or for no reason.

 

7. Ownership of Intellectual Property, Copyrights, and Logos

The Product and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Alison Adsit, Owner of Framed Visions, LLC. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

 

8. Indemnification

You agree to indemnify and hold Alison Adsit, Owner of Framed Visions, LLC harmless from any demands, loss, liability, claims, or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the products offered on the website.

 

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Alison Adsit, Owner of Framed Visions, LLC, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service. 

To the maximum extent permitted by applicable law, Alison Adsit, Owner of Framed Visions, LLC assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our products; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

11. Dispute Resolution

In the event that agreements can not be made between us and you, these Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of Colorado, United States of America, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Larimer County, Colorado.
